Terms and Conditions
Payment for tours: Is by cash or check made out to 'Paige Bouzaglou' and mailed to P.O. Box 8472, Red Bank NJ 07701. All tour payments and bookings are handled by Paige Bouzaglou and Wandering Gosling Travel Agent in Red Bank NJ 07701.
Bookings: Bookings are confirmed on receipt of payment only. Payment of a deposit and your participation on a tour constitutes your acceptance and agreement to be bound by these Terms and Conditions. On receipt of payment, guest is mailed or sent a confirmation email of place/s on tour. This correspondence is receipt of payment and acceptance of liability agreement.
Pricing: The price of international tours is based on foreign exchange rates and tariffs valid at the time of print. Noble Garden Tours LLC reserves the right to reserve
Itinerary Changes: Noble Garden Tours LLC reserves the right to change dates, times, and rates when such changes are compelled by circumstances beyond its control. Noble Garden Tours LLC reserves the right to withdraw a tour or any portion of the tour at anytime or make changes in the published itinerary whenever in its sole judgment conditions warrant or if it deems it necessary for the comfort, convenience or safety of the passengers.
Cancellations: Noble Garden Tours LLC reserves the right to cancel a tour if minimum booking numbers are not met. You will be telephoned if the tour is cancelled. If you have to cancel and the place can be filled, either by you finding a replacement or from the wait list, you will receive a full refund. Cancellations received 1 month or less prior to departure will not be refunded unless your place can filled. If Noble Garden Tours cancels the tour, you will receive a full refund. All refunds will be issued in the form of a check or may be transferred to a future trip. There is no refund for arriving late, leaving a tour early or missing activities.
Activity Level: Guests must expect that all garden tours are very active and involve 4+ hours of walking. International tours may be longer and more active. Many destinations involve inclines, steep steps, walking through gardens or fields and uneven terrain. Guests must be confident of managing this varying terrain. As per the Terms, the guest assumes full responsibility for knowing the expectations of the tour and her/his capacity to manage the activity demands.
Limitation of Liability: Noble Garden Tours LLC and its agents act only as agents for the passenger with respect to services provided passengers by others including and not limited to the airline industry, hotels, restaurants, sightseeing and transportation (such as aircraft, motor coach, railroad, steamship, cruise line, automobile or other conveyance). Noble Garden Tours and its agents expressly disclaim all responsibility or liability of any nature whatsoever for loss, damage or injury to property or person due to any cause whatsoever, occurring during the tour under their management, sponsorship, procurement or otherwise and the tour participant agrees to waive any claim against Noble Garden Tours for any injury, loss, damage, defect in any vehicle, or act, omission, negligence, accident, error or default or any company or person engaged in providing such services to the tour. Noble Garden Tours reserves the right to change dates, times, and rates when such changes are compelled by circumstances beyond its control. Noble Garden Tours reserves the right to withdraw a tour or any portion of the tour at anytime or make changes in the published itinerary whenever in its sole judgment conditions warrant or if it deems it necessary for the comfort, convenience or safety of the passengers. The motor coach concern shall not be held responsible for any act, omission or event during the time passengers are not on board the conveyance. The sole and exclusive responsibility and liability of the motor coach company shall be in accordance with and as limited by the contract carrier in the passenger’s ticket and the applicable tariffs.
All tour services including but not limited to hotels, restaurants, guide services, cruise line, airlines and other transportation are furnished by contractors that are independent and do not act for or on the behalf of Noble Garden Tours LLC.
Guests assume full responsibility for parking their vehicle while participating on a tour and release Noble Garden Tours LLC from any and all liability in all matters relating to their parked vehicle.
Payment of a booking fee to Paige Bouzglou and Noble Garden Tours LLC includes an assumption that these conditions have been read and understood, thereby releasing and discharging Noble Garden Tours, its agents and employees from and against any and all liability arising from participation in the tour. This release is legally binding upon the guest, their heirs, successors, assigns and legal representatives; it being the guest's intention to fully assume all risk of travel and to release Noble Garden Tours from any and all liabilities to the maximum permitted by law.
